Smiths Forensic Accounting

We can prepare or critically-analyse claims for disturbance compensation arising from the displacement of a business, resulting in relocation or full/partial extinguishment.

At an early stage in the CPO process, drawing on our significant experience of preparing and critiquing claim calculations, we can provide advice in relation to potential areas of loss and the documentary evidence that would be required to support a robust claim.

As matters progress and disturbance compensation discussions commence:

  • Acting on behalf of a claimant party, we can provide forensic accounting advice to inform your dispute strategy or settlement negotiations. We can prepare business valuations, loss calculations and assessments of additional costs incurred. We can also advise on the relative strengths and weaknesses of each element of your claim from a quantum perspective.
  • Acting on behalf of the defendant party, we can perform a critical appraisal of the claim presented by the opposing party and prepare alternative calculations, as required.

We produce clear, concise reports to facilitate informed settlement discussions. Where required, we can hold discussions with the opposing party’s accounting advisors to identify areas of agreement and seek to narrow the differences between the parties.

Should the matter proceed to Tribunal, we understand the obligations of an expert witness and are highly experienced in preparing expert witness reports and joint statements for legal proceedings.

All of our deliverables are reviewed by both partners, with consultation and challenge provided throughout each engagement, ensuring that reports and valuations are robust and stand up to scrutiny.
