Depending on your requirements, we can provide forensic accounting input throughout the lifecycle of a commercial dispute:

  • At an early stage in the dispute, we can provide advice to inform your dispute strategy or settlement negotiations.
    • Instructed on behalf of the claimant party, we can prepare loss calculations or business/share valuations and advise on the relative strengths and weaknesses of your position from a quantum perspective.
    • Instructed on behalf of the defendant party, we can perform a critical appraisal of the claim presented by the opposing party and present alternative calculations, as required.
  • We produce clear and concise reports to facilitate informed settlement discussions.
  • Should the matter proceed to Court, we understand the obligations of an expert witness and are highly experienced in preparing expert witness reports and joint statements for Court proceedings. We have both given expert evidence in Court.
  • All of our deliverables are reviewed by both partners, with consultation and challenge provided throughout each engagement, ensuring that reports and valuations are robust and stand up to scrutiny.

Our commercial disputes experience includes:

  • Consequential loss claims: quantification of claims for loss of profits arising from, for example, breach of contract, professional negligence or business interruption matters.
  • Shareholder disputes: acting for individual shareholders or as an independent expert for both parties to prepare a robust valuation of shares in a private company.
